High Court Nullifies ANC Dissolution, Declares Party Legally Existing
The High Court has ruled that the dissolution of the Amani National Congress (ANC) and its merger with the United Democratic Alliance (UDA) were unconstitutional and unlawful, effectively restoring ANC as a legally registered political party.
In its judgment delivered on Thursday, the court found that the process used to dissolve the party failed to meet the constitutional and legal requirements set out in the Political Parties Act. The judge consequently nullified the Gazette Notice that formalised the dissolution and ordered the Registrar of Political Parties to reinstate ANC in the official register.
The court further directed that all assets transferred from ANC following the purported merger be returned to the party and barred any disposal or interference with its property. It held that ANC’s legal personality had never been lawfully extinguished.
The ruling carries significant political implications ahead of the 2027 General Election, reopening debate on party mergers and coalition arrangements and reinforcing the need for strict adherence to the law in political party processes.
